These Hosting Terms (the “Hosting Terms”) govern content you publish for public access through the hosted-pages features of the Services — landing pages and landing sites, hosted forms, surveys, and chat widgets served on a public subdomain we provide or a domain you connect (together, “Hosted Content”). They are part of our Terms of Service and use its definitions; for Hosted Content, where the two conflict, these Hosting Terms prevail. By publishing Hosted Content — including by accepting these Hosting Terms when creating a landing page in the product — you (the “Publisher”) agree to them; if you accept on behalf of a Customer workspace, you confirm you are authorised to bind it.
Our Role: Technical Hosting Only
We provide automatic, technical hosting: we store the files you upload and deliver them to visitors as published. We do not create, commission, select, edit, review, or endorse Hosted Content; we have no general obligation to monitor it; and our automated processing — link rewriting, embed detection, security scanning, quota enforcement — is technical, not editorial. Hosted Content is the Publisher’s content, not ours: every statement, offer, price, and promise on a hosted page is made by the Publisher alone, and visitors deal with the Publisher, not with Cognitify. Nothing on a hosted page implies our endorsement.
We act as a provider of hosting services within the meaning of Article 6 of Regulation (EU) 2022/2065 (the Digital Services Act) and, for United States copyright purposes, as a service provider under Section 512 of the Digital Millennium Copyright Act. We rely on the liability protections these and similar laws afford intermediaries that host third-party content, including Section 230 of the U.S. Communications Decency Act.
Publisher’s Responsibility
You are solely responsible for Hosted Content and for everything that follows from publishing it — its legality, its accuracy, and its effect on visitors. By publishing, you represent and warrant that:
- you own, or hold a valid licence for, every element of the content — text, images, video, fonts, code, trademarks, and personal likenesses;
- the content is lawful both where you operate and in the jurisdictions you direct it to, and complies with the advertising, consumer-protection, and sector rules that apply to your offer;
- the content is not misleading: claims are truthful, prices and conditions are stated honestly, and endorsements are genuine;
- any legally required notices — company identification, imprint, privacy notice, cookie or consent banners — are present, and for personal data collected through hosted pages you are the data controller with a lawful basis;
- if you sell through a hosted page, the transaction — delivery, taxes, warranties, refunds, support — is entirely between you and your customer.
Prohibited Content and Uses
You must not publish, link to, or distribute through Hosted Content:
- content that is illegal, or that promotes or facilitates illegal activity;
- content that infringes intellectual-property or other rights — pirated material, counterfeit offers, unlicensed use of others’ work or brands;
- child sexual abuse material or any sexual content involving minors — zero tolerance, reported to the authorities;
- content that harasses, threatens, defames, or incites hatred or violence;
- fraud or deception of any kind: phishing, scams, fake shops, impersonation of other businesses or people, fabricated reviews or endorsements, deceptive “get-rich” schemes;
- malware, or code that attacks, tracks, or exploits visitors beyond what the page discloses — including hidden miners and covert fingerprinting;
- offers of regulated goods or services where you lack the required licence — weapons, drugs, prescription medicines, gambling, financial services;
- spam or search-manipulation pages (doorway pages, typosquatting, link schemes), or use of the hosting for bulk file distribution unrelated to a landing site.
We may extend this list as new kinds of abuse appear; the current version is always the one published on this page.
Reporting Illegal or Infringing Content
Anyone may report Hosted Content by email to info@cognitify.ai. So that we can act quickly, include: the exact URL(s); an explanation of why the content is illegal or violates these Hosting Terms; your name and email address; and a statement that you believe in good faith that the report is accurate and complete. Copyright reports should additionally identify the protected work and the rightsholder, and may follow the DMCA notice format; a knowingly false report may make you liable for the damage it causes.
On receiving a sufficiently precise and substantiated notice — or an order from a court or competent authority — we act expeditiously: we may remove or disable the content, the page, the subdomain, or the workspace’s hosting, and we inform the Publisher of the action and its reasons unless the law prevents us. The Publisher may respond with a substantiated counter-statement, and we may restore content we conclude was removed in error. Publishers who repeatedly or seriously violate these Hosting Terms lose access to hosting under the “Suspension and Termination” section of the Terms of Service.
Enforcement
We may remove or disable Hosted Content, and suspend or limit hosting features, whenever we reasonably believe content violates these Hosting Terms, exposes visitors or third parties to harm, creates legal exposure for us, or endangers our infrastructure or our relationships with the platforms it runs on. Where practicable we give notice first; where the risk is immediate — malware, phishing, child sexual abuse material, a binding order — we act first and notify after. Enforcement is not editorial control: acting, or declining to act, on one page does not oblige us to review any other.
Technical Scope and Visitor Data
- Hosting is static (front-end) only — HTML, CSS, JavaScript, and media — served through third-party edge and CDN infrastructure that we may change at any time;
- storage and traffic limits of your plan apply, and hosting is provided “as is” under the warranty and availability terms of the Terms of Service;
- data that visitors submit through hosted forms, surveys, and chat widgets lands in the Publisher’s workspace as Customer Data: the Publisher is the controller of that data, and our processing of it is governed by the Terms of Service and the Privacy Policy.
No Liability for Hosted Content; Indemnity
To the maximum extent permitted by law, Cognitify is not liable — to the Publisher, to visitors, or to any third party — for Hosted Content: for what it says or omits, for goods or services offered through it, or for any loss caused by reliance on it. Claims about a hosted page belong with its Publisher. You will defend and indemnify Cognitify — including reasonable legal fees — against any third-party claim, demand, or proceeding arising from your Hosted Content or your breach of these Hosting Terms; this extends the “Indemnity” section of the Terms of Service. Everything else about liability between you and us, including the aggregate cap, is as set out in the Terms of Service.
Changes, Governing Law, and Contact
We may update these Hosting Terms as the hosting features and the law evolve; material changes are announced as provided in the Terms of Service, and continued publication after the effective date constitutes acceptance. These Hosting Terms are governed by the laws of the Republic of Estonia, with the same jurisdiction as the Terms of Service.
